ENFIELD INLAND WETLANDS AND WATERCOURSES AGENCY

SPECIAL MEETING

1. Call to Order: The special meeting was called to order by Chairperson Pfeifer-Hall at 6:33 p.m.

2. Roll Call: Present were: Chairperson Gretchen Pfeifer-Hall and Agents Arnone, Szewczak and Wawer. Also present were Steven Sadlowski, Wetlands Agent and Susan Berube, Recording Secretary.

3. Approval of Minutes -- Oct. 17, Nov. 8, Nov. 21 Meetings: A motion was made by Agent Arnone and seconded by Agent Szewczak to approve the minutes of the meeting of October 17, 2006 with the following amendment: Page 3, 9th paragraph, add the letter “e” to “grad”. Vote was 3-0-1(Wawer).

A motion was made by Agent Arnone and seconded by Agent Wawer to approve the minutes of the meeting of November 8, 2006 with the following amendment on page 11, 5th paragraph, 2nd sentence: remove “There”; replace with “Past degradation”. Vote was 3-0-1(Wawer).

A motion was made by Agent Szewczak and seconded by Agent Arnone to approve the minutes of the meeting of November 21, 2006 with the following amendment: page 16, 1st paragraph, remove “tae” and replace with “take”. Vote was 4-0-0.

3. Show Cause Hearing

IW Violation 2006-11-30 - Charles and Ellen Mastroberti, 54 Weymouth Rd.

· Violation of IW Permit #424 - failure to follow permit conditions

· Violation of Section 6.1 of the Enfield Inland Wetlands and Watercourses Regulations - conducting a regulated activity without a permit (filling of wetlands): a motion was made by Agent Arnone and seconded by Agent Wawer to uphold the Wetlands Orders dated December 8, 2006 issued to Ellen and Charles Mastroberti, 54 Weymouth Road, as part of Violation # 2006-11-30.

Furthermore, as per discussion of the Agency members at this special meeting, the agent is advised to forward the case to the Town Attorney’s office on December 20, 2006 for the filing of an enforcement action against the Mastroberti’s.

If by December 20, 2006 (5 days), the Mastroberti’s provide a notarized statement of intent to the Wetland’s Agent indicating their desire to obtain the necessary permit and to reclaim the property to the conditions stated on the site plan, as approved by the Agency, the legal action will be delayed until February 1, 2007.

During this suspension, the applicant will develop and provide a complete plan of reclamation along with an appropriate application and fee, to the Inland Wetlands and Watercourses Agency by February 1, 2007 (50 days), will work diligently to get said plan approved by the spring planting season, and will complete all reclamation work by July 1, 2007 unless otherwise approved by the Agency.

Failure to complete any of these required elements, within their specified time frames, will immediately trigger the filing of an enforcement action against Mr. and Mrs. Mastroberti. Vote was 4-0-0.

• Next regular meeting is Tuesday, December 19, 2006 at 7:00PM in the Council Chambers.

5. Adjourn: A motion was made by Agent Wawer and seconded by Agent Arnone to adjourn the meeting at 7:52 p.m. Vote was 4-0-0.
