1. Call to order and Pledge of Allegiance – Vice Chairman James Hickey, Jr. called the meeting to order at 7:30 p.m.

6. PUBLIC HEARINGS – Continued from April 7, 2005 meeting
a. PH#2496 – Special Use Permit to convert a 3-unit residential building to a 4-unit residential building at 148 Pearl Street, zoned R-33, Map 21, Lot 54, Michael T. Sirois, Applicant/Owner. (Must close by May 5.) – This public hearing was continued to May 5, 2005. The Commission requested that the applicant provide them with a copy of the deed showing the owner of this property.

a. PH#2495 – Special Use Permit for a restaurant beer and wine permit at 535 Hazard Avenue, zoned BL, Map 101, Lot 189, Daniel Poggie, Applicant/Owner. (Must close by 5/26). – This public hearing was closed.
Commissioner Duren made a motion, seconded by Commissioner Krebs, to approve a Class I beer and wine permit for Daniel Poggie as heard in Public Hearing #2495 with the seven conditions included in the memo from Jose Giner to the Commission dated April 21, 2005. The motion was approved by a 7 – 0 – 0 vote.
b. PH#2500 – Special Use Permit for a modification of existing Kohl’s Plaza (Elm Plaza) for demolition of former Waldbaum’s Supermarket and the construction of a new Best Buy store, adjacent retail and new out parcel building in existing parking lot with related site work at 95 Elm Street, zoned BR, Map 43, Lot 1, Kimco Realty Corp, Applicant/KIOP Enfield L.P., Owner. (Must close by 5/26) – This public hearing was closed.
Commissioner Duren made a motion, seconded by Commissioner Krebs, to approve a special use permit for a modification of an existing Kohl’s Plaza building (a/k/a Elm Plaza) to include the demolition of the former Waldbaum’s Supermarket and the construction of a new Best Buy store, adjacent retail and new out parcel building in existing parking lot with related site work at 95 Elm Street with the 19 conditions as outlined in the memo from Jose Giner to the Commission dated April 21, 2005. Condition 20 was added which is the Traffic Safety Officer’s letter of approval shall be placed in the file of this application. The motion was approved by a 7 – 0 – 0 vote.

SPR#1312 – Application for renovation of tower and interior finishes at 130 Elm Street (TGI Friday Restaurant), zoned BR, Map 57, Lot 329, Kimberly Dixon, Applicant/Galileo Freshwater…, Owners. – Commissioner Duren made a motion, seconded by Commissioner Lefakis, to approve SPR#1312, renovation of tower and interior finishes at 130 Elm Street (TGI Friday Restaurant) with the eight conditions as outlined in a memo from Jose Giner dated April 21, 2005. The motion was approved by a 7 – 0 – 0 vote.
b. SPR#1313 – Application for change of use permit for an academic and activity enrichment program for preschool aged children at 585 Hazard Avenue, zoned BG, Map 110, Lot 12, Kristi Bonazelli, Applicant, P&D Realty, Owners. – Commissioner Weseliza made a motion, seconded by Commissioner Sarno, to approve SPR#1313, application for a change of use permit for an academic and activity enrichment program for preschool aged children at 585 Hazard Avenue with the five conditions as outlined in the memo from Jose Giner dated April 21, 2005. The motion was approved by a 5 – 0 – 0 vote.

a. Section 8-24 Referral – For acceptance of roadway easements (Stateline Plaza redevelopment) granted by Galileo Freshwater/Stateline LLC and Monroe Muffler Brake, Inc. – Commissioner Duren made a motion, seconded by Commissioner Krebs, to approve the 8-24 referral and recommend acceptance to the Town Council of the roadway easements granted by Galileo Freshwater/Stateline LLC and Monroe Muffler Brake, Inc. The motion was approved by a 7 – 0 – 0 vote.
b. Applications to be received.
The following applications were received by the Commission:
PH#2501 – Application for a zone change from R-33 to BL Map 26, Lots L-5, L-10, L-15, and L-20 Elm Street and a portion of Lot L-360 Enfield Street with Enfield Street Design District Overlay, North side of Elm Street, Frank Troiano, Applicant/Owner. – A public hearing will be scheduled for May 5, 2005.
PH#2502 – Application requesting amendment of Section 8.60 to add subsection 8.60 (G), Frank Troiano, Applicant. – A public hearing will be scheduled for May 5, 2005.
PH#2503 – Application for subdivision for division of property into two lots at 2 Shaker Road, zoned BL and I-1, Map 64, Lot 70, Galaxy Development Group, LLC, Owner. - A public hearing will be scheduled for May 5, 2005.
PH#2505 – Application for resubdivision of 14 acres +/- parcel into two parcels – Parcel 1 to be 0.85+/- acres and will include existing package store, parcel 2 to be 11.84 +/- acres and will remain unchanged at 229 Post Office Road, zoned BL, Map 68, Lot 151, Edward E. Wojnar, Applicant/Owner.
A public hearing will be scheduled for May 19, 2005.
SPR#1316 – Application for modification of plans previously approved to build a cardboard dumpster pad at 99 Restaurant location at 54 Hazard Avenue, zoned BR, Map 56, Lot 26, Tom Leoni of 99 Restaurant, Applicant/94 West, Inc., Owner.
SPR#1317 – Application for site plan review for replacement of a 4-family with a 3-family at 124-126 Pearl Street, zoned R-33, Map 21, Lot 63, Richard Binns, Applicant/Eleanor Binns, Owner.

Adjournment – Commissioner Weseliza made a motion, seconded by Commissioner Krebs, to adjourn. Following a unanimous vote, the Commission adjourned at 8:37 p.m.
