1.      Call to Order & Pledge of Allegiance – Chairman Anthony DiPace called the meeting to order at 7:30 p.m.

2.           Roll Call – Chairman Anthony DiPace and Commissioners Jeffrey Cooper, Charles Duren, Robert Egan, James Hickey, Jr., Karen Krebs, Kathleen Sarno, Alternate, and Nicles Lefakis, Alternate were present.

3.           Approval of Minutes –  November 3, 2005 – Commissioner Krebs made a motion, seconded by Commissioner Cooper, to approve the Minutes of November 3, 2005.  The Minutes were approved by a 6 – 0 – 1 vote.

8.     PUBLIC HEARINGS - Continued from November 17, 2005 meeting

a.     PH#2526 - Conditional Approval for a proposed 15-lot residential re-subdivision at end of Meetinghouse Lane and north of Bridge Lane with a proposed road intersection with Bridge Lane at #44 Bridge Lane, zoned R-33, Map 19, Lots 1 and 10; Margaret R. Pappas, Applicant/Owner.  (Must close by December 1) – This public hearing was continued to January 19, 2006 with receipt of an extension from the applicant.  Chairman DiPace requested that this hearing be re-advertised.

The Commission recessed at 8:50 p.m. and reconvened at 9:05 p.m.

9.     PUBLIC HEARINGS - NEW

a.     PH#2531 – Application for Special Use Permit for unmerging of 2 lots of record at #30 O’Hear Avenue, zoned R-33, Carl Nelson Construction, Inc., Applicant/John T. and Mary M. Sessa, Owners. (Must close by January 5, 2006) – Commissioner Duren made a motion, seconded by Commissioner Krebs, to accept the withdrawal of PH#2531, 30 O’Hear Avenue, Carl Nelson Construction, Inc., Applicant/John T. and Mary M. Sessa, Owners, without prejudice.  The motion was approved by a 7 – 0 – 0 vote.

9.     PUBLIC HEARINGS - NEW (continued)

b.     PH#2533 – Application for modification of plans previously approved to allow each home to place a shed no larger than 100 square feet in each yard at Pheasant Hill Planned Community, zoned R-44, Map 16, Lot 39, Pheasant Hill Homeowners Association, Applicant/Owner. (Must close by January 5, 2006) 

Following receipt of a letter granting the Commission an extension of this public hearing from Attorney Paul Smith, Chairman DiPace continued this hearing until January 12, 2006 at which time the Commission will schedule a special meeting. 

Commissioner Duren made a motion, seconded by Commissioner Cooper, to extend the meeting to complete tonight’s agenda.  The motion was approved by a unanimous vote.

10.       Old Business

a.     Discussion of complaint re: vegetation clearing/landscaping at Pheasant Hill Planned Community off Weymouth Road.

b.     Discussion of PH 2510 - Polek Subdivision letter received at November 17 meeting. – Commissioner Duren made a motion, seconded by Commissioner Krebs, to approve the recommendation of the Town staff regarding bonding for PH#2510 (posting of a $2,627 maintenance bond and landscaping bond).  The motion was approved by a 7 – 0 – 0 vote.

                   Commissioner Duren made a motion, seconded by Commissioner Cooper, that the Secretary is authorized to sign the plans for PH#2510 – Polek Subdivision – without the plan showing existing lot lines for clarification purposes.  The motion was approved by a 7 – 0 – 0 vote.

12.       Bond Releases

a. PH #2347/SPR#1196 - Request for release of Landscape Bond in the amount of $9,802.50, for Tolland Bank (now New Alliance Bank) 73 Hazard Avenue – Commissioner Duren made a motion, seconded by Commissioner Krebs, to release the landscape bond in the amount of $9,802.50 for Tolland Bank (now New Alliance Bank), 73 Hazard Avenue.  Reference is made to the memo from Virginia Higley dated November 21, 2005.  The motion was approved by a 7 – 0 – 0 vote.

b. PH #2323 & 2322 - Request for release of Erosion & Sediment Bond of $4,000 on the frontage lots of Shaker Heights Subdivision on Taylor Road by Chet Ladd. – Commissioner Duren made a motion, seconded by Commissioner Krebs, to release the erosion and sediment bond in the amount of $4,000 for the frontage lots of the Shaker Heights Subdivision on Taylor Road/Chet Ladd, PH#2323 and 2322.  Reference is made to the email from John Cabibbo to Virginia Higley dated November 17, 2005.  The motion was approved by a 7 – 0 – 0 vote.

c.  PH #2309 - Request for release of Phase I Engineering bond in the amount of $634,600 and Erosion & Sediment Control Bond for Phase 1 in the amount of $14,000.29 for Autumn Fields on Elm Street. – Commissioner Duren made a motion, seconded by Commissioner Krebs, to approve release of the Phase I Engineering bond in the amount of $634,600 and the erosion and sediment control bond for Phase 1 in the amount of $14,000.29 for Autumn Fields on Elm Street.  Reference is made to the November 17, 2005 email from John Cabibbo to Virginia Higley.  The motion was approved by a 7 – 0 – 0 vote.

d.   PH #2487 - Request for release of Erosion & Sediment Control Bond in the amount of $530 for Stop & Shop Fueling Station at 54 Hazard Avenue. – Commissioner Duren made a motion, seconded by Commissioner Krebs, to release the erosion and sediment control bond in the amount of $530 for the Stop & Shop Fueling Station at 54 Hazard Avenue.  The motion was approved by a 7 – 0 – 0 vote.

a.   Regulations Workshop

b.   Applications To Be Accepted – The following applications were accepted by the Commission:

PH#2535 – Application for a Special Use Permit for package store (liquor, wine, beer, cigarettes and soft drink) at 156 Hazard Avenue, Unit #3, Zoned BL, Map 74, Lot 254, Bahadur Singh, Applicant/Karies Properties, LLC, Owner. 

A public hearing will be scheduled on December 15, 2005.

PH#2536 – Application for Subdivision – Development of two (2) single-family homes; extension of Yale Court and related services, water, etc., utilities, zoned R-33, Map 18, Lot 281, Ridgewood Homes of Connecticut, LLC, Applicant/Owner.

A public hearing will be scheduled on February 2, 2006.

SPR#1349 – Application for change to a sports apparel and clothing store at 94 Pearl Street, zoned TVCZ, Map 24, Lot 116, Gregory Rabb & Emon Saleh, Applicants/Bruce Weintraub, Owner. 

It was the consensus of the Commission to allow Jose Giner to handle this application administratively.

SPR#1350 – Application to move Health Department offices to the second floor to use in present condition with removable partitions at 31 North Main Street, zoned TVCZ, Map 27, Lot 115, North Central Health Department, Applicant/Joseph Cimino, Owner.   

It was the consensus of the Commission to allow Mr. Giner to handle the move of the Health Department to the second floor at 31 North Main Street administratively in order for them to occupy the premises by the first of the year.  The Commission will review this site plan for the entire building at a later date.

SPR#1351 – Application for modification of previously approved plans by Midas Service Center to freshen the look of their building by painting at 5 Palomba Drive, zoned BR,Map 57, Lot 320, Midas Service Center, Applicant/Balis Automotive Realty, Owner.

SPR#1352 – Application for administrative approval for an 88” long by 38” wide by 60” tall emergency generator on the southeast side of existing building at at 175 Freshwater Blvd., Zoned IP, Map 55, Lot 1, Aldrich Construction, Applicant/Eppendorf Real Estate, Owner.

The Commission directed Mr. Giner to handle this application administratively.

14.          Adjournment – Commissioner Krebs made a motion, seconded by Commissioner Duren, to adjourn.  Following a unanimous vote, the Commission adjourned at 11:15 p.m.
