1. Call to Order & Pledge of Allegiance – Chairman Anthony DiPace called the meeting to order at 7:30 p.m. and requested a moment of silence in memory of Former Town Councilman Carl Scarfo.
2. Roll Call – Present were Chairman Anthony DiPace and Commissioners Elizabeth Ballard, Jeffrey Cooper, Charles Duren, James Hickey, Jr., Jason Jones and Charles Ladd, Alternate.

6. PUBLIC HEARINGS - NEW
a. PH#2538 – Petition to amend zoning map from R-88 to R-44 for 75 +/- acre parcel with access at end of Kennedy Drive, Map 90, Lot 128, Villages, LLC, at Town Farm Road/Applicant/James Furey, Owner. (Letter of withdrawal received) – Commissioner Duren made a motion, seconded by Commissioner Ballard, to accept the withdrawal of PH#2538 without prejudice. The motion was approved by a 7 – 0 – 0 vote with Alternate Ladd voting.
b. PH#2540 – Special Use Permit/Site Plan Review to modernize existing façade and revitalize landscape at Brookside Plaza, 10-38 Hazard Avenue, Map 56, Lot 22, Cubellis Associates, Agent for Equity One, Applicant/Equity One, Owner. (Must close by 4/20) – This public hearing was closed.
Commissioner Duren made a motion, seconded by Commissioner Cooper, to approve Public Hearing #2540 with the seventeen conditions as outlined in a memo from Jose Giner to the Planning and Zoning Commission dated March 16, 2006 with the following modifications: in Condition #3, the following sentence was added: Three to four Bradford Pear Trees are to be added between each curb cut on the Hazard Avenue frontage; Condition #7 would read: 7. No work may begin on the landscaping modifications until permits have been issued and work has begun on the facade improvements except for the two driveway entrances subject to Planning Office staff approval.
The motion was approved by a 7 – 0 – 0 vote with Alternate Ladd voting.
c. PH#2543 – Special Use Permit application to convert a three-family residence to a four-family residence at 150 Bernardino Avenue, zoned R-33, Map 35, Lot #227, Michael Bernier, Applicant/Owner. (Must close by 4/20) – This public hearing was closed.
Commissioner Duren made a motion, seconded by Commissioner Cooper, to approve PH#2543 with the fifteen conditions as outlined in a memo to the Planning and Zoning Commission from Jose Giner dated March 16, 2006 and the addition of Condition 16 which reads: 16. The north arrows shall appear on the plan sheets along with the identification of the adjacent street locations.
The motion was approved by a 7 – 0 – 0 vote with Alternate Ladd voting.
d. PH#2544 – Petition for proposed amendment to Section 3.30 (Miscellaneous Provisions) to allow front porches to encroach into the front setback in residential districts, Enfield Planning and Zoning Commission, Applicant. (No closing date.) This public hearing was closed.
Commissioner Duren made a motion, seconded by Commissioner Jones, to approve PH#2544 with the following additions to the proposed amendment as stated by Jose Giner during the public hearing: Item D. shall read: “D. In any residential district except the TVCZ District, unenclosed front porches may project up to eight feet into the required front yard setback or the front building line of a pre-existing nonconforming structure subject to the following:…”
Item ii was revised as follows: “ii) Non-enclosed front porch steps may project an additional six feet provided that they be no closer than 15 feet to a front property line and provided that neither the steps nor the porch may be closer than 15’ to a front property line.
The effective date of this amendment is April 1, 2006.
Commissioner Jones made a motion, seconded by Commissioner Ladd, for a recess. Following a unanimous vote, the Commission recessed at 9:45 p.m. The Commission reconvened at 9:55 p.m.
e. PH#2545 – Petition for proposed amendments to zoning regulations regarding the regulation of storage trailers and containers, Enfield Planning and Zoning Commission, Applicant. (No closing date) This public hearing was closed.
Commissioner Duren made a motion, seconded by Commissioner Ladd, to approve PH#2545, the proposed amendments to the zoning regulations regarding the regulation of storage trailers and containers with the following changes as mentioned during the public hearing: Definitions should be added for storage container, temporary storage container, and temporary truck trailer; remove the phrase flammable or other where mentioned and insert instead hazardous material/waste; in item C. under subsection i it should read: i. The containers shall only be allowed for temporary storage in conjunction with a bona-fide moving operation; a remodeling job on the same premises for which a building permit has been issued; or to store items for a house that has been damaged by fire, explosion or natural disaster and is awaiting repairs.
The motion was approved by a 7 – 0 – 0 vote with Alternate Ladd voting.
Commissioner Duren made a motion to take items out of order and consider SPR#1356 at this time. The motion was approved by a unanimous vote with Alternate Ladd voting.
f. PH#2546 – Petition for Zone Change at 878, 900 and 904 Enfield Street from Business General (BG) to Thompsonville Village Center Zone (TVCZ), Map 26, Lots 12, 13, and 14, Enfield Planning and Zoning Commission, Applicant, New Fairfield Properties Realty Trust (878); Fleet National Bank of Conn. (900); and Fleet National Bank of Conn. Trust – Catherine Algiere Trustee (904) – owners. (No closing date). – This public hearing was closed.
Commissioner Duren made a motion, seconded by Commission Jones, to approve the zone change at 878, 900 and 904 Enfield Street from Business General (BG) to Thompsonville Village Center Zone (TVCZ), Map 26, Lots 12, 13 and 14 as heard in Public Hearing #2546 with an effective date of April 1, 2006.
g. PH#2547 – Petition for proposed amendment to subdivision regulations regarding length of dead end roads and cul de sacs, Enfield Planning and Zoning Commission, Applicant. (No closing date.) – This public hearing was closed.
Commissioner Duren made a motion, seconded by Commissioner Hickey, to approve the amendment to the subdivision regulations as heard in PH#2547 regarding the length of dead end roads and cul de sacs. The motion was approved by a 7 – 0 – 0 vote with Alternate Ladd voting. The effective date of this amendment is April 1, 2006.

a. SPR#1356 – Application for church activities in a leased space that includes prayer meetings, bible studies and church business meetings at 548 Enfield Street, zoned BL, Map 33, Lot 62, Salem Church, Inc., Applicant/Stanley Glemboski, Jr., Owner. – Chairman DiPace did not participate in this application. Commissioner Duren made a motion, seconded by Commissioner Ladd, to approve SPR#1356, application for church activities in a leased space that includes prayer meetings, bible studies and church business meetings at 548 Enfield Street subject to the six conditions as outlined in a memo from Jose Giner to the Commission dated March 16, 2006. The motion was approved by a 6 – 0 – 0 vote with Alternate Ladd voting and Chairman DiPace not participating.

The following applications were received by the Commission:
PH #2552 - Application for subdivision to divide a 5.42 acre piece into 4 lots, one for an existing house and garage and three for new construction at 205 State Street (off Enfield St.) zoned R-33, Carl Nelson Construction, Inc., Applicant/Owner.
A public hearing will be scheduled for April 6, 2006.
PH #2553 - Special Use Permit and Site Plan Review for change of use to construction and electrical contractors with site location for permanent storage areas at 167 South Road, Zoned I-1, Map 55, Lot 81, Matthew Auchy, Applicant/Owner.
A public hearing will be scheduled for April 20, 2006.
SPR #1357 - Application for cardboard and paper compactor at 4 Anngina Drive, Zoned I-1, Map 82, Lot 60, John & Martha O'Brien, Applicant/ Owner.
SPR #1358 - Application for small grocery store; change of use from embroidery shop at 27 North Main Street, Zoned TV, Map 27, Lot 116, Armando Chavez, Applicant/Michael T. Panella, Owner.
11. Adjournment – Commissioner Jones made a motion, seconded by Commissioner Hickey, to adjourn. Following a unanimous vote, the Commission adjourned at 10:35 p.m.
