REGULAR MEETING

1.       Call to Order & Pledge of Allegiance: Chairman DiPace called the meeting to order at 7:37 p.m.

2.       Roll Call : Present were Anthony DiPace, Chairman and Commissioners Jeffrey Cooper, Charles Duren, James Hickey, Jr., Jason Jones, Karen Weseliza,  Nicles Lefakis, Alternate, Kathleen Sarno, Alternate, and Charles Ladd, Alternate.  Alternate Ladd was seated as a voting member.

Also Present:  José Giner, AICP,  Director of Planning,

3.       Approval of Minutes – July 6, 2006 - A motion was made by Commissioner Hickey and seconded by Commissioner Cooper to approve the minutes of the meeting of July 6, 2006.  Vote was 6-0-1 (Jones).

4.       Correspondence: No votes taken

A Motion was made by Commissioner Duren and seconded by Commissioner Jones to add two items to Bond Releases: item 10 b.  PH 2181 – Request for release of $2,902.50 landscaping bond for Enfield Transit Mix on Broad Brook Road. and Item 10 c. PH2444 – Request for release of $30,000 landscaping bond for Camerota Truck Parts on Shaker Road. Vote was 7-0-0.

5.       Commissioner’s Correspondence: No votes taken

6.       PUBLIC HEARINGS – Continued from July 6, 2006 meeting

a.       PH#2550 – Amendment to the Enfield Zoning Regulations, Section 12.20, Enforcement and Administration, to require as-built surveys for foundations before allowing framing to begin and to set requirements for such surveys, Staff Initiative. Continued to September 7, 2006.

7.       PUBLIC HEARINGS - NEW

a.       PH #2563 – Modification of Condition #2 of approved Special Use Permit PH# 1414.02 to change the approved hours of operation from 10:00 a.m. to 2:00 p.m. and 8:00 p.m. to 7:00 a.m. and not on Sundays, to allow unrestricted hours of operation up to a maximum of 90 hours per week for an existing crematorium at 61 South Road, Zoned R-33, Map 73, Lot #88/Portion of Lot 89, Leete-Stevens, Inc., owner/applicant.  Closed Hearing - No votes taken.   

b.       PH # 2564 – Special Use Permit under Section 3.40.1 c of the Enfield Zoning Regulations to allow a change from one non-conforming use (automotive general repairs license) to another (wholesale used vehicles dealer) at 41 Mullen Rd. in an R-44 District, Map 49 Lot 1, Paul Varno, applicant; John Sheehan, owner. Chairman DiPace recused himself from this application and left the hearing room.  Vice-Chairman Hickey presiding. Alternate Lefakis sitting in for Chairman DiPace.

The Hearing was Closed. A motion was made by Commissioner Duren and seconded by Commissioner Cooper to find that the application met the criteria of reducing a non-conforming use if subjected to the conditions suggested by the Planning Director and those discussed at the hearing.  Vote was 7-0-0

A motion was made by Commissioner Duren and seconded by Commissioner Jones to APPROVE PH # 2564 – Special Use Permit under Section 3.40.1 c of the Enfield Zoning Regulations to allow a change from one non-conforming use (automotive general repairs license) to another (wholesale used vehicles dealer) at 41 Mullen Rd. in an R-44 District, Map 49 Lot 1, Paul Varno, applicant; John Sheehan, owner. This application is subject to conformance with the submitted record and the following conditions:

 Conditions:

1.  The conditions of this approval shall be binding on the applicant, land owners, and their successors and assigns.

2.  This approval will become effective upon the filing of a Special Use Zoning Certificate signed by the Commission Secretary on the Land records by the owner of the property.

3.  This approval is for the specific use identified in the application.  Any change in the nature of the use will require new approvals from the Enfield Planning and Zoning Commission.

4.  This approval extinguishes the non-conforming use of the property for auto body and general repairs to the public.

5.  There is no site work proposed or approved in conjunction with this application.

6.  This project shall be maintained in accordance with the submitted plans and application record.  Minor modifications to the plans may be allowed in accordance with the regulations, subject to staff review and approval.

7.  By acceptance of this permit and conditions, the applicant and owner acknowledge the right of Town staff to periodically enter upon the subject property for the purpose of determining compliance with the terms of this approval.

8.  Hours of operation (including pick-up and delivery of vehicles) are limited to 9 a.m. to 6 p.m. Monday through Saturday with no Sunday activity permitted.

9.  This approval allows only wholesale sales of vehicles. No retail sales to the public are permitted.

10.    Parking of vehicles other than licensed cars shall be limited to the fenced in area located in the back of the building.

Vote was 7-0-0

8.       Old Business

          a.       PH#2553 – Special Use Permit and Site Plan Review for change of nonconforming use to construction and electrical contractor’s yard with site location for permanent storage areas at 167 South Road, zoned I-1, Map 55, Lot 81, Matthew Auchy, Applicant/Owner.  A motion was made by Commissioner Duren, seconded by Commissioner Jones to APPROVE the application as presented.  The application was denied by a vote of 0-7-0.  Reasons given for denial were:
The applicants had not responded to requests for application to the Enfield Inland Wetlands and Watercourses Agency and therefore no report had been received as required by law; The applicants failed to adequately prove that the proposed use of the property was not an increase in the non-conforming use over what was previously there.

9.       New Business

          a.       SPR# 1362 – Request under Section 9.10.5 D. for phasing of required bond at 540 Enfield Street to require that only those portions of site work not completed be bonded prior to issuance of a Certificate of Compliance, Ida DiPace, Owner of Adspresso, LLC.  Chairman DiPace recused himself from this application and left the hearing room.  Vice-Chairman Hickey presiding. Alternate Lefakis sitting in for Chairman DiPace. A motion was made by Commissioner Duren and seconded by Commissioner Cooper to approve the request.  Vote was 7-0-0

          b.       SPR #1376 - Request for site plan review to construct an 18,900 sq. ft. addition to their existing manufacturing and office facility as well as the extension of the parking area and necessary site improvements at 4 Peerless, Zoned I-1, Map 94, Lot 69, Associated Builders, Applicant/Senior Operations, Inc., Owner. A motion was made by Commissioner Weseliza and seconded by Commissioner Hickey:

TO APPROVE SPR #1376 - Request for site plan review to construct an 18,900 sq. ft. addition to an existing manufacturing and office facility as well as the extension of the parking area and necessary site improvements at 4 Peerless Way, Zoned I-1, Map 94, Lot 69, Associated Builders, Applicant/Senior Operations, Inc., Owner. This application is subject to conformance with the referenced plans and the following conditions:

Conditions to be Met Prior to Signing of Plans:

1.  All plans submitted for signature shall require the seal and live signature of the appropriate professional(s) responsible for the preparation of the plans.

2.  The Application number, “SPR # 1376” shall be displayed prominently on the final plan sheets either in the title block or in the area around it.

3.  The conditions of this approval shall be binding on the applicant, land owners, and their successors and assigns. 

Conditions to be met prior to the issuance of permits:

4.  Final approval for any new sewer connections must be obtained from the Water Pollution Control Division.

 

5.  Two sets of paper plans, with any required revisions incorporated on the sheets, shall be submitted to the Planning Department for signature of the Commission. In accordance with Section 9.10.6 of the Regulations, the applicant shall also submit final plans in a digital format prescribed by the Director.

6.  A pre-construction meeting between the applicant, site contractors, project engineer and Town Staff shall be held.

7.  The applicant shall post a bond for Site improvements in an amount to be determined by the Town Engineer and with surety acceptable to the Town Attorney.

8.  A Separate Erosion and Sediment Control Bond shall be submitted in the form of a passbook, pledged to the Town, in an amount to be determined by the Town Engineer.

9.  A landscaping bond, in an amount to be determined by the Planning Department shall be submitted to the Town.

Conditions which must be met prior to the Issuance of a Certificate of Compliance :

10.    Complete as-built plans certified to Class A-2 accuracy shall be submitted prior to the issuance of any certificates of zoning compliance.

11.    In accordance with Section 9.10.6 of the Regulations, the applicant shall also submit final plans in a digital format prescribed by the Director.

General Conditions:

12.    This approval is for the specific use and structure identified in the application.  Any change in the nature of the use or the structure will require new approvals from the Enfield Planning and Zoning Commission.

13.    This project is also subject to conditions of the Enfield Inland Wetlands and Watercourses Agency .

14.    This project shall be constructed and maintained in accordance with the referenced plans.  Minor modifications to the approved plans may be allowed in accordance with the regulations, subject to staff review and approval.

15.    All work associated with the construction of facilities as approved must be completed by July 20, 2011 or this approval shall be rendered null and void, unless an extension is granted by the Commission.

16.    By acceptance of this permit and conditions, the applicant and owner acknowledge the right of Town staff to periodically enter upon the subject property for the purpose of determining compliance with the terms of this approval.

Vote was 7-0-0

          c.       SPR #1377 – Site Plan review for modification of previously approved parking and landscaping layout at 109 Elm St., Zoned BG, Map 43, Lot 7, AAA-Allied Group, LLC, Applicant/Owner. A motion was made by Commissioner Weseliza and seconded by Commissioner Jones:

TO APPROVE SPR #1377 – Site Plan review for modification of previously approved parking and landscaping layout at 109 Elm St., Zoned BG, Map 43, Lot 7, AAA-Allied Group, LLC, Applicant/Owner. This application is subject to conformance with the referenced plans and the following conditions:

10.     Bond Releases

          a.       SPR #1368 - Request by Dan Roulier Builder for release of Engineering Bond in the amount of $127,800 and Erosion & Sediment Bond in the amount of $7,200 for the Medical Building on 170 Hazard Ave. A motion was made by Commissioner Hickey and seconded by Commissioner Jones to approve the release of the bonds as recommended by the Assistant Town Engineer.  Vote was 7-0-0.

          b.       PH 2181 – Request for release of $2,902.50 landscaping bond for Enfield Transit Mix on Broad Brook Road. A motion was made by Commissioner Duren and seconded by Commissioner Jones to approve the release of the bond as recommended by the Assistant Town Planner. Vote was 7-0-0.

          c.       PH2444 – Request for release of $30,000 landscaping bond for Camerota Truck Parts on Shaker Road. A motion was made by Commissioner Duren and seconded by Commissioner Jones to approve the release of the bond provided that a bond for wetland enhancement plantings in the amount of $17,000 be submitted. Vote was 7-0-0.

11.     Other Business

a.       PH 2552 – Request for extension of time for filing mylars for Carl Nelson’s 4 lot subdivision on State Street. Commissioner Duren made a motion, seconded by Commissioner Cooper to approve the request for extension of the mylar filing deadline.  Vote was 7-0-0.

b.       Request from Enfield Mall to allow the reduction of sidewalk from 16’ to 8’ in front of the northeast entrance to Sears. A motion was made by Commissioner Hickey and seconded by Commissioner Jones to allow the Planning Director to handle this item as an Administrative Review. Vote was 7-0-0.

c.       Director of Planning Report : No votes taken.

d.       Applications To Be Received.

          PH #2567 - Application for a Special Use Permit to add 6 ft. 10 inches to length of existing deck o rear of house using the existing steps at 32 Pheasant Hill Drive, Zoned R-44 Map 16, Lot 39, Dennis Bracci, Applicant/Owner.  Public Hearing set for September 7, 2006.

          SPR #1378 - Request for site plan review to install short handicap ramp to access the door landing that is up one step from the parking area at 51 College St., Zoned TVC, Map 27, Lot 102, David Berto, Applicant/Owner. It was the consensus of the  Commission to allow the Planning Director to handle this item as an Administrative Review.

12.     Adjournment – Commissioner Weseliza made a motion, seconded by Commissioner Hickey to adjourn the meeting at 9:54 p.m. Vote was 7-0-0.
