ENFIELD TOWN COUNCIL MINUTES OF A PUBLIC HEARING APRIL 16, 2001
A Public Hearing was held in the Council Chambers of the Enfield Town Hall, 820 Enfield Street, Enfield, Connecticut on Monday, April 16, 2001. Chairwoman Strom called the Public Hearing to order at 7:02 p.m.
ROLL-CALL Present were Councilmen Egan, Falk, Fiore, Giddings, Hall, Kaupin, Mangini, Strom, and Vayda. Councilmen Dodd and McGuire were absent. Also present were Assistant Town Manager, Daniel Vindigni; Town Clerk, Suzanne F. Olechnicki; Assistant Town Attorney, Maria Stavropoulos; Director of Public Works, John Kazmarski; Director of Finance, Gregory Simmons
Chairwoman Strom read the notice of Public Hearing which was published in the Journal Inquirer on Saturday, April 7, 2001 as follows:
TOWN OF ENFIELD LEGAL NOTICE PUBLIC HEARING MONDAY, APRIL 16, 2001
“NOTICE IS HEREBY GIVEN that the ENFIELD TOWN COUNCIL will hold a Public Hearing in the Enfield Town Hall, Council Chambers, 820 Enfield Street, Enfield, Connecticut on Monday, April 16, 2001 at 7:00 p.m. to allow interested citizens an opportunity to express their opinions regarding the proposed AMENDMENTS TO THE SOLID WASTE ORDINANCE.
Copies of the proposed amendments are available for public inspection in the Office of the Town Clerk, 820 Enfield Street, Enfield, Connecticut Monday through Friday, 9:00 a.m. to 5:00 p.m.”
Mr. Kazmarski explained there are two significant changes proposed in the Solid Waste Ordinance Section (c). containers for multi-family dwellings. He noted that requires that multi-family dwellings bring refuse out to the curb in tipper barrels. He referred to the other change which has to do with Section 8 B-7, Penalties. He noted the last sentence would be deleted.
Councilman Mangini questioned why tipper barrels are mandated. Mr. Kazmarski stated they are trying to get more utilization of the tipper barrel. He added many multi-family dwellings are located in tight quarters, and using tipper barrels would be more efficient and cleaner.
Councilman Vayda questioned what recourse there is if violations continue. Mr. Kazmarski stated his belief there would be a $50 fine for each offense. Councilman Vayda stated his belief it should be made clear that theres a fine for subsequent offenses.
Councilman Falk stated his belief one of the original purposes of the tipper barrels was to reduce back injuries.
Councilman Hall questioned whether they need to specify the property owner has to purchase the tipper barrels. Attorney Stavropoulos stated this does not have to be specified, however, the Council can include that language if it wishes. It was agreed to include language that specifies its a requirement of the property owner to purchase the tipper barrel.
Councilman Fiore raised the issue of eliminating the appeals board and questioned whether such a change would invalidate this public hearing. Attorney Stavropoulos stated her belief eliminating the appeals board would be a substantial change.
Jeanne Veser, 7 Margaret Street Questioned if theres a violation and a fine, is that directed at the property owner or tenant, and Chairwoman Strom responded the property owner.
As no others wished to speak, Chairwoman Strom closed the Public Hearing at 7:17 p.m.
