A meeting of the Enfield Town Council, acting in its official capacity as Water Pollution Control Authority, was called to order by Chairman William Vayda in the Town Council Chambers, Enfield Town Hall, 820 Enfield Street, Enfield, Connecticut on Monday, August 5, 2002 at 10:06 p.m.

ROLL-CALL - Present were Commissioners Edgar, Egan, Fiore, Hall, Kaupin, Mangini, Strom, Tait, and Vayda.  Commissioner Tallarita was absent.  Also present were Town Manager, Scott Shanley; Assistant Town Manager, Daniel Vindigni; Town Clerk, Suzanne F. Olechnicki; Assistant Town Attorney, Maria Stavropoulos; Director of Public Works, John Kazmarski; Deputy Director of Public Works, Geoffrey McAlmond.

APPROVAL OF MINUTES

MOTION #6018 by Commissioner Tait, seconded by Commissioner Mangini to accept the minutes of the July 1, 2002 meeting.

Upon a SHOW-OF-HANDS vote being taken, the Chair declared MOTION #6018 adopted 9-0-0.

MOTION #6019 by Commissioner Fiore, seconded by Commissioner Mangini to waive the reading of the resolution.

Upon a SHOW-OF-HANDS vote being taken, the Chair declared MOTION #6019 adopted 9-0-0.

RESOLUTION #6020 by Commissioner Kaupin, seconded by Commissioner Tait.

A Resolution re:  Accepting the Amended Grease Trap Ordinance

Commissioner Fiore questioned whether this has gone before Planning & Zoning at all, and does it need to go before Planning & Zoning.  Mr. Kazmarski stated the old ordinance spoke specifically to this Committee and/or the Water Pollution Control Plant and the Director of Public Works and office of the Director of Health.

Mr. Shanley stated Planning & Zoning makes a point of asking those questions on behalf of Water Pollution Control and on behalf of the ordinance in place.  He noted they could get an advisory opinion, however, he doesn't know why it would be necessary to get approval.

Mr. Kazmarski pointed out Planning & Zoning reviews the plans which include the large exterior grease traps, however, P&Z doesn't really get involved with the internal grease traps, but rather it's reviewed by his office, the Health District and the Building Inspector.

Commissioner Tait stated the Health Department's memo asked a series of good questions. He questioned whether those questions are answered within this ordinance.  Mr. Kazmarski stated the way the ordinance has been modified, it gives some flexibility.  He indicated the second paragraph, last two sentences of the ordinance address those questions.  Mr. Shanley added part of the ordinance will bring all the aberrant grease traps through the Public Works to this Committee for final approval.

Commissioner Hall questioned whether there's anything in the ordinance that would go out to the non-compliant businesses and who will police that.  Mr. Kazmarski stated his belief there's nothing specifically stated in the revised or original ordinance.  As far as inspections of the grease traps and what the ramifications are of non-inspection, he stated his belief it's a combined thing, i.e., if they get a report of grease coming out of a particular area, they report it to the Health District, and he believes it's their responsibility to insure that the grease traps are in fact being monitored or maintained properly in order to give a food handling establishment a clean bill of health to continue operation.  He stated his belief the proposed changes coming from DEP will strengthen this more.  Mr. Shanley added one of the things they discussed was an amnesty period where if people know they're not in compliance, they can go through the process and get into compliance within a six-month period with no penalty or revocation of license.

MOTION #6021 by Commissioner Strom, seconded by Commissioner Tait to table this item.

Upon a SHOW-OF-HANDS vote being taken, the Chair declared MOTION #6021 adopted 9-0-0.

RESOLUTION #6022 by Commissioner Hall, seconded by Commissioner Egan.

WHEREAS, Resolution #973 was duly adopted by the Enfield Town Council acting in its official capacity as the Water Pollution Control Authority at a Special Meeting held on the 15th day of April 2002, in part declaring a nine (9) month moratorium on the requirement of "exterior" grease traps for restaurants and food service establishments; and

WHEREAS, Joanie's Ice Cream and Eatery will comply with the requirements of Town Code Section 8-32 using an "interior" grease interceptor and requested a variance from the requirement of an "external" grease trap; and

WHEREAS, the office of the Director of Public Works has reviewed the requested variance and found it in compliance with conditions as follows:

1)      Variance is valid for only Joanie's Ice Cream and Eatery at 101 Raffia Road and is non-transferable

2)      Any change in use, menu, or ownership shall be submitted to the office of Director of Public Works and the North Central Health District for compliance evaluation to this variance

3)      Establishment shall remain in full compliance with the requirements of the North Central Health District

4)      A current written agreement for the minimum quarterly cleaning and the maintenance of the grease interceptor shall be maintained on file with the office of the Director of Public Works and the North Central Health District

5)      Failure to remain in compliance with these conditions shall automatically cause the variance to be rescinded

THEREFORE, BE IT RESOLVED, the Enfield Water Pollution Control Authority does hereby approve a variance for Joanie's Ice Cream and Eatery at 101 Raffia Road to allow for usage of an "interior" grease interceptor in lieu of an "exterior" grease trap with conditions as listed.

Upon a ROLL-CALL vote being taken, the Chair declared RESOLUTION #6022 adopted 9-0-0.

Upon a SHOW-OF-HANDS vote being taken, the Chair declared MOTION #6024 adopted 9-0-0, and the meeting stood adjourned at 10:28 p.m.
