MONDAY, APRIL 17, 2006
Before the Regular Meeting was called to order, Mayor Tallarita presented a proclamation to the A.W. Hastings Company.
The Regular Meeting of the Enfield Town Council was called to order by Chairman Tallarita in the Council Chambers of the Enfield Town Hall, 820 Enfield Street, Enfield, Connecticut on Monday, April 17, 2006 at 7:37 p.m.
PRAYER – The Prayer was given by Councilman Ragno.
PLEDGE OF ALLEGIANCE – The Pledge of Allegiance was said.
ROLL-CALL – Present were Councilmen Crowley, Edgar, Hilinski, Kaupin, Lee, Mangini, Nelson, Peruta, Ragno and Tallarita. Councilman Maxellon was absent. PUBLIC COMMUNICATIONS
Mrs. Collins, the Hazardville Section
Stated her hope nothing unsightly will be erected behind the senior citizen center for the purpose of the community garden.
Denise Duclos, 38 O’Hear Avenue
Stated on April 7th she sent a letter to the Council regarding a situation that has arisen on her street because the Town issued a resident a kennel license. She expressed her appreciation to Town agencies that are reviewing her complaint as concerns the safety of her children.
Ms. Duclos stated it’s upsetting that there seems to be no current background check process required before a kennel license is issued. She noted it only makes sense to run a records check on nuisance complaints and visits to the home by local and/or state animal control, or to see how many times mail has been withheld from an address due to a loose dog.
She noted after receiving personal responses from Councilman Lee and Mangini, as well from Assistant Town Manager, Daniel Vindigni, she has been given the impression that there’s a general consensus regarding the need to change or update the current policy.
She displayed a photograph of one of the pit bulls from #36 running in her yard which was taken on April 11, 2006 at 12:38 p.m. She pointed out this photo shows the neighbor’s fence and the logs her husband placed along that fence to keep the neighbor’s dogs and puppies from coming under the fence. She noted this meant her husband had to modify the neighbor’s fence to keep the neighbor’s dogs contained in the neighbor’s backyard. She feels there’s something very wrong with this. She stated her hope this shows that they are willing to do what they need to do as a way to keep their children safe in their own backyard.
Ms. Duclos displayed another photograph of one of the German Shepards fighting with one of the pit bulls in the yard of #36. She noted this photograph shows three adults, two of whom are the dog owners, attempting to separate the animals. She stated this photo also shows the dogs unleashed, which according to Animal Control Officer Wilson is allowed as long as the dogs are under control of the homeowner. She noted Officer Wilson informed her the Town has an “in control of your dog” law, not a leash law, which does not require the dog to be on a lead whether on private property or public property as long as the owner is in control of the animal.
She pointed out the photo of the fighting dogs with three adults attempting to separate them proves not only that these dogs can be violent, but also proves that the dog owners are not in control of their animals. Ms. Duclos stated this was the second incident of this type within two weeks. She noted she also has copies of the Town records of nuisance complaints to the police dispatcher animal control office, and the records show Animal Control was called out to the home in April, 2005, twice in September, and once in October, 2005, however, these records are incomplete as they are missing at least two nuisance complaints which were sent by e-mail. She stated these e-mails were sent by her to Animal Control and Chief of Police Marcotte. She noted Animal Control responded to the first complaint, however, after the second e-mail was received, she was asked to call instead of e-mail.
She stated in the complaint dated September 9, 2005, she watched one of the German Shepards chase two male Jehovah Witnesses off the property of #34. She noted she immediately called the police to report the incident and explained to the dispatcher that the dog was now in the home of #36. She pointed out these are not homeowners in control of their animals.
Ms. Duclos stated in the complaint dated April 6, 2005, a German Shepard was loose and roaming both in her yard and other neighbors. She noted Animal Control responded and found the gate open and fence broken, and a pink slip was left for the homeowner.
She stated in the complaint dated September 1, 2005, the same German Shepard was loose and roaming. She noted Animal Control responded, and the homeowner of #36 admitted that the dog had broken her fence and she was in the process of fixing it. She pointed out this fence has been broken since April, and if she hadn’t continued to complain, the fence and gate might still be broken.
She concluded stating that by pointing out specific complaints, she is hoping to show the Council and other Town officials that the homeowners at #36 have not shown the responsibility required to take proper care of the ten dogs that they had before they were issued their kennel license. She pointed out the September 1st complaint shows that the Animal Control Officer who responded found all ten dogs in the home unlicensed. She stated her hope she has been able to raise a few red flags regarding the dog limits and the way kennel licenses are issued in this town. She expressed her appreciation for the prompt attention to this matter.
Jack Sheridan, 7 Buchanan Road
Stated his hope a future agenda will included a discussion item regarding a policy on disclosure of lot conditions on new homes or projects. He stated his belief there’s a real need to protect a potential buyer, particularly as concerns water problems. He pointed out this information should be readily available without an individual having to dig for such information.
Mr. Sheridan spoke about the need for the Town to have a locker-type disposal site at the Town Garage to collect hazardous waste such as mercury thermostats and thermometers so that residents can dispose of these items promptly rather than holding onto them while waiting for the yearly hazardous waste day. He noted some people may end up disposing of such items improperly.
Charles Woods, 11 Westerly Drive
Stated he feels better about how recent meetings have been going.
Mr. Woods referred to Item 13e on this evening’s agenda and questioned if “undesignated” means excess money or money that was supposed to be used for something else. He questioned what is causing this $30,000 transfer.
Margaret Jedziniak, 232 Abbe Road
Stated her impression that services aren’t equitable throughout the town or school system. She feels the town and school system treat some people more favorably than others.
COUNCILMEN COMMUNICATIONS & PETITIONS
Councilman Mangini requested an update on the congressional request for appropriations that was sent in March. She noted a couple items were sent through Senator Lieberman and Congressman Simmons’ offices.
Councilman Mangini referred to the notice from the Forest Fire Service and requested some background information as to how this effects the Town.
Councilman Mangini stated she received an e-mail indicating this is the 50th season of the Enfield Little League, and there will be a Jamboree on May 20th. She noted the Little League is looking for business and resident sponsors to support the youth of the community. She stated donations can be sent to the Enfield Little League to support their Lights On Program.
Councilman Nelson stated he visited the home on O’Hear Avenue, and he feels the kennel license issue should be reviewed. He noted the kennel license issued on O’Hear Avenue relates to a very small property, and he questions having ten or more dogs on such a property and within this neighborhood environment. Chairman Tallarita stated leadership requested Mr. Vindigni provide clarification on licensing requirements, as well as what the Council can do.
Councilman Nelson stated perhaps the Town Garage should make provisions to collect items containing mercury.
Councilman Kaupin questioned the difference between “in control of dogs” vs. the leash law.
Councilman Lee stated the whole move toward compact fluorescence has been going on for a couple years, and these bulbs contain mercury, and there are very specific disposal requirements when these bulbs burn out. He noted there are state regulations that require stores clearly document that these bulbs do contain mercury as well as disposal options. He questioned if Public Works comes up with ideas for disposal of mercury thermostats and thermometers, can they also consider these light bulbs.
As concerns disclosure on properties, particularly water issues, Councilman Peruta questioned whether this is a Planning & Zoning type of thing or is this something the Council would address through an ordinance.
Councilman Peruta referred to the dog problem and questioned what course of action does the homeowner have regarding roaming dogs. He added he knows these types of problems can relate to all breeds of dogs.
Councilman Nelson referred to the issue of new construction and lot conditions and pointed out all builders in the State of Connecticut are required to warranty a home for one year from the date of the closing. As concerns disclosing lot conditions, lots that never had water problems developed water problems after last year’s flooding.
Chairman Tallarita referred to the 50-year Little League notice and suggested coordinating this with the re-dedication of the field.
Chairman Tallarita stated his belief disclosure issues with regard to real estate are more governed by State statutes as opposed to municipal regulations. He noted he wants to avoid the Town building on another level where the Town would not have any enforcement ability. He suggested Mr. Sheridan put his concerns in writing, and perhaps the legal department and Planning & Zoning can look at this.
Chairman Tallarita stated his recollection there was discussion about the mercury disposal issue and that the MDC indicated they do collect mercury as part of their collection process. He requested Public Works address this with Mr. Sheridan, and if the Town needs to follow up on this, they can do that.
As concerns the “undesignated classification” question raised by Mr. Woods, Chairman Tallarita explained this is from the fund balance area and relates to monies that are not dedicated and available for things that come up during the year. He explained this particular item is for human resource legal fees, however, they cannot go into detail about this because it involves a legal matter which needs to be discussed in Executive Session. He noted the Council understands these monies are being used for legal issues, and in a lot of cases those legal issues are on-going. He explained this wouldn’t be the proper venue to have that type of discussion because it could compromise the Town’s position in those legal matters.
As concerns Ms. Jedziniak’s concerns about equitable treatment of residents, Chairman Tallarita stated his belief the Council tries to treat each resident the same.
TOWN MANAGER REPORT & COMMUNICATIONS
Mr. Vindigni stated the dog situation on O’Hear Avenue is still being reviewed. He noted he has referred this matter to the Chief of Police, the Town Planner, Zoning Enforcement, the Town Attorney and the Health Department. He noted he will have more information within the next week. He added he will be sure Ms. Duclos gets information as well.
As concerns the mercury disposal concern raised by Mr. Sheridan, Mr. Vindigni stated mercury will be accepted by the Household Hazardous Waste Collection program, as well as other participating communities involved in that program. He noted the Deputy Director of Public Works can further explain this.
Chairman Tallarita suggested the Town’s website be kept updated so residents understand what types of materials are part of the recycling program or part of the MDC collection program and how to dispose of items. He added perhaps the annual report could address this issue as well. He stated it may just be a matter of communications as opposed to setting new policies. Mr. Vindigni stated they can definitely look at the website, and if there’s room on the annual report they may be able to include some information.
Mr. Vindigni referred to Councilman Mangini’s inquiry regarding the congressional request and stated he will follow up on this item to learn what the status is. He added he will also follow up on the Forest Fire Service notice. He stated his belief this notice was forwarded to the fire chiefs as well.
TOWN ATTORNEY REPORT & COMMUNICATIONS
As concerns the dog issue, Attorney Bromson advised the resident should continue with what she is doing. He noted if these dogs are loose and pose a threat, she should be calling the police each and every time. He pointed out there are enforcement issues whereby arrests can be made, and prosecutors take these cases very seriously. He stated residents have the right to protect their life and property, and residents can take whatever steps necessary to insure the safety of themselves and their children. He pointed out the different Town offices will be looking at this issue. He acknowledged this is a scary situation since large, powerful dogs can inflict a lot of damage on a young child.

DISCUSSION RE: VIDEOTAPING OF COUNCIL MEETINGS
Councilman Lee stated CCM surveyed all the communities in the state to determine which ones utilize public access or community access in the programming of government content within their communities. He suggested taking another couple weeks to review what has been received from CCM.
Councilman Mangini questioned the status of the letter that was to be sent to Cox. Mr. Vindigni indicated that letter has not yet been sent.
Councilman Peruta stated his understanding there was to be a donation of equipment. He questioned the status on this. Councilman Lee clarified there was some equipment being offered to the community to utilize as a permanent or semi-permanent way to tape live events. He noted the problem in determining whether this will work is that they do not yet know where they will have the ability to do live feeds. He stated his belief the value in this donated equipment is that it would allow Enfield to have live coverage of events. He stated Enfield needs to determine where it wants to do live broadcasting. He added if the public access community wishes to take advantage of this equipment, and the Town of Enfield does not, there still might be an opportunity to use it. He noted once Cox completes its survey and lets the Town know where and how much live coverage will cost, they can make a conclusion.

DISCUSSION RE: TRASH HAULING PERMITS
Mr. McAlmond stated they put together a proposed resolution to re-establish the Solid Waste Advisory Committee to take up those topics raised by the Council. He noted a sunset date of December 4th has been included for the final report. He questioned if the Council would like to include recyclable items as well as household hazardous waste.
Chairman Tallarita referred to the five citizens being appointed by the Town Manager as opposed to being appointed by the Town Council. He noted he would like to see this revert back to the way they typically form these committees. Mr. Vindigni stated this particular commission was appointed by the Town Manager, but the Town Council can change that. Chairman Tallarita stated he would like to be consistent with the practice over the past six years. He agreed they should also look at the recycling issue as well.
Councilman Kaupin agreed with Mr. McAlmond regarding adding recycling and household hazardous waste. He noted this Commission should address three major items that they can concentrate on, and they should know that their term of service has an end so they don’t feel overburdened. He feels this is a good resolution, and he would like to see this go forward. He stated it might help the process and result in continuity if they appoint some of the members who previously served on this commission.
Chairman Tallarita stated his understanding this committee would look at establishing some type of credit program at the transfer station whereby the casual user of the transfer station could receive some type of credit or possibly there could be an open period. Mr. McAlmond stated some of the staff from the transfer station and the Solid Waste Superintendent presented some excellent ideas, and they would like to present those ideas to the committee.
Chairman Tallarita stated some main things the Council would like this committee to look at are the tipper barrel program, household recycling, the transfer station operations and possibly some type of credit for residents, and the code and ordinances that require permitting.
Councilman Nelson questioned what happens to yard waste after it comes to the landfill. He noted some residents are complaining because they never had to pay to get rid of yard waste in the past, and now they’re paying 5 cents a pound to dispose of this material at the landfill. Mr. McAlmond stated that material is processed and the Town is paying in excess of $60 per ton to dispose of yard waste brought into the landfill. He noted it’s less expensive for the Town to pick up yard waste at the curb. He went on to note there are sometimes unscrupulous people who hide other items within the yard waste they haul to the landfill, and the Town is then fined $2,000 by the vendor whose equipment is damaged, or they get a fine from CRRA for a contaminated load because perhaps someone disposed of a battery within their yard waste. He noted the charge to the resident covers those situations that do occur because some people don’t follow the rules.

Mr. Vindigni stated this is an annual grant program that’s received specifically for relocation of residents due to some type of heating or energy problem in their home resulting in the resident(s) being temporarily homeless. He noted this is not related to the emergency management program, but rather this is designed specifically for social services.

RESOLUTION #8765 by Councilman Mangini, seconded by Councilman Hilinski.
WHEREAS, the Metropolitan District, a specially chartered municipal corporation with offices at 555 Main Street, Hartford, Connecticut (the “MDC”) has offered the Town ofEnfield the opportunity to participate in their regional 2006 Household Hazardous Waste Collection (HHWC) program, and
WHEREAS, participating in the MDC’s HHWC program will provide for one Household Hazardous Waste Collection day to be held within the Town of Enfield and permission for Town residents to have access to utilize the collection program days held outside of the boundaries of the Town during calendar year 2006, and
THEREFORE, BE IT RESOLVED, the Enfield Town Council hereby authorizes the Acting Town Manager to execute an agreement with the MDC for the Town to participate in their 2006 Household Hazardous Waste Collection Program.
Mr. McAlmond stated there are 18 scheduled days starting this Saturday in Farmington and continuing through November 4 in Windsor Locks. Chairman Tallarita questioned if the dates get posted on Enfield’s website. He noted the collection day in Enfield is scheduled for May 13, 2006 at the DPW complex on Moody Road. He pointed out residents can attend any of the 18 collection days without any fees in any of the participating communities. Mr. McAlmond stated residents need only show a driver’s license indicating they live in Enfield.
Chairman Tallarita questioned if the website will show what can be collected, and Mr. McAlmond responded yes, and every year they publish ads in the paper. He added they will collect thermostats.
Councilman Peruta stated his understanding they collect car batteries. He questioned if they collect regular batteries. Mr. McAlmond indicated he would check into this.
Councilman Edgar questioned whether this has been reviewed by the Town Attorney’s office. Mr. McAlmond stated it was submitted to the Town Attorney’s office for review, but he has not yet had a response. He added this is the same agreement the Town has been involved with for at least the last eight years. Mr. Vindigni stated the Town Manager’s office did not receive any adverse comment back from the Town Attorney’s office.

Chairman Tallarita explained this is a transfer of funds to cover legal expenses in the Human Resource Department. Mr. Vindigni added this relates to a number of pending cases. Chairman Tallarita stated the Council has been made aware of each of those cases during Executive Session.

PUBLIC COMMUNICATIONS
Denise Duclos, 38 O’Hear Avenue
Stated Animal Control Officer Wilson told her a leash is only required on pets when on Town property, otherwise a person can walk down the street with a pet as long as they are in control of that pet. She stated her belief that is a very gray statement.
Ms. Duclos produced another photograph which was taken on Friday of the neighbor’s dog loose in the streets, however, because the homeowners were with the dog at the time, she could not file a formal complaint because technically the owners were in control of their pet. She stated she was also told she cannot harm a dog unless she can show proof of attack. She noted she had to file the written complaints using the photograph of a pit bull running through her yard in order to possibly have #36 fined. She noted there is a possible $96 fine for a roaming dog. She stated this fee can be fought in court, even though there’s a photograph of the neighbor’s dog roaming on her property. She added she was also told that part-time animal control officers cannot issue tickets which means they have to go to the sergeant or whoever is in charge of the police station at that time and show them the complaint, and if it’s okayed to issue a fine, a regular officer has to go to the home to issue a ticket.
Ms. Duclos stated it was also suggested to her to contact revenue services and explain people can only have one and a half litters of puppies per year before they have to apply for a tax permit. She stated her understanding that’s the only way people can have their kennel license taken away. She noted the Health Department does not believe the odor issue is something the Health Department handles, but rather they believe it’s an issue for
Agriculture. She noted the Health Department took their complaint, but she hasn’t seen anything done about this complaint.
Jack Sheridan, 7 Buchanan Road
As concerns the disclosure issue, Mr. Sheridan stated he is not talking about the basements that are dug and are dry at the time they’re initiated, but rather he’s talking about test pits. He voiced concern about those situations where they hit water at one foot in a test pit. He stated his belief there should be a regulation or policy by the Town concerning this issue. He pointed out he approached Planning & Zoning concerning this, and they told him the regulation comes from the Town side, and P&Z implements those regulations.
As concerns mercury disposal, Mr. Sheridan pointed out all fluorescent light bulbs have mercury within them. He stated his concern is that people find it more convenient to throw these items in the regular trash rather than wait for the household hazardous waste program dates to roll around. He stated his belief they should have a controlled drop-off place.
Mrs. Collins, the Hazardville Section
Stated she has a problem with dogs leaving a mess on her lawn even when they are on a leash. Mr. Vindigni stated there is an animal waste ordinance.
COUNCILMEN COMMUNICATIONS
Councilman Edgar stated his belief if part-time animal control officers are sworn in, they have the power of arrest. He noted in the past, part-time animal control officers could issue citations. He went on to note that pictorial evidence is direct evidence, and that is sufficient to issue a summons. Mr. Vindigni stated he will look into this.
Councilman Mangini noted the streetlights across from the fire station in Thompsonville are dim or out. She stated as a result, there’s a whole section that is rather dark. Mr. Vindigni stated Public Works will follow up on this.
As concerns the dog leash issue, Councilman Kaupin stated he was told that at one time the part-time animal control officers did have the power to ticket, but it was taken away from them by a former Chief of Police.
As concerns the leashing of dogs as relates to Town property, Councilman Kaupin questioned what constitutes Town property. He questioned if a sidewalk and road are considered Town property. Attorney Bromson stated there will be a comprehensive review of this topic.
Chairman Tallarita stated he has seen other communities that provide disposal bags plus containers for dog waste. He noted Enfield Street is heavily walked by people and people with dogs. He questioned what the cost might be if they put out bags and disposal receptacles at key sites.
Chairman Tallarita requested Mr. Vindigni follow up on the Little Country Store in Thompsonville. He noted Mr. Warren met with this business owner, and they were meeting with the Post Office. He suggested possibly the Town Hall and School Department could utilize this satellite post office in Thompsonville. He encouraged people to use that office because it would be good to keep this postal service in this end of town.
Councilman Peruta questioned if the next meeting could include an update concerning the drainage issue on Edgewood off of Steele Road and the Collin/Middlesex/Windham neighborhood. He added he will e-mail this request to Mr. Vindigni.
